ARTICLE 1 - APPLICATION SCOPE

These general terms and conditions of sale, serving as the foundation for commercial negotiations, are non-negotiable and cannot be altered, regardless of any provisions found in the buyer's documentation, notably their general terms and conditions of purchase. These terms and conditions of sale take precedence, as stipulated by Article L. 441-6 of the French Commercial Code.

In compliance with prevailing regulations, these general conditions of sale are routinely provided to any inquiring buyer to facilitate placing orders with the seller. They unconditionally apply to all transactions conducted by A10 Equipment® with buyers seeking to acquire products showcased on the seller's website, www.a10-equipment.com.

The website remains accessible 24/7, barring closures for maintenance, repair, or in cases of force majeure.

These general terms and conditions of sale are perpetually available on the website and supersede any alternative versions or conflicting documents.

They remain in force for the entirety of the online services provided by A10 Equipment® and are subject to modification by A10 Equipment® at any time. 

ARTICLE 2 - PRICES

2.1 - Our product prices are quoted in Euros, including all taxes, but excluding shipping costs. However, prices cannot be changed once the order has been placed.

2.2 - The currency of payment is Euro.

2.3 - A10 Equipment® reserves the right to change the prices of its products at any time. Products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability.

2.4 - Our prices take into account the VAT rate in force at the time of invoicing and are therefore subject to change according to changes in legislation. 

ARTICLE 3 - ORDER - VALIDATION

3.1 - A10 Equipment® reserves the right to refuse any order from a customer with whom there is a dispute relating to the payment of a previous order. Any order implies acceptance of the prices and descriptions of the products on sale.

3.2 - The information provided by the purchaser when placing an order is binding. In the event of an error in the recipient's contact details, A10 Equipment® cannot be held responsible for the impossibility of delivering the product.

3.3 - The order validation process includes several stages during which you must validate your order summary. By clicking on the "Validate" button, you confirm your order and declare your full and unreserved acceptance of these general terms and conditions of sale, particularly the retention of title and jurisdiction clauses in articles 9 and 14 respectively. This confirmation and all computer data recorded by A10 Equipment® will be considered as proof of our transactions.

3.4 - A10 Equipment® will send you two notifications per order by email: "Preparation Pending" and "Shipped".

Only when A10 Equipment® has sent the customer an acknowledgement of receipt of the order, the sale will be considered definitive.

3.5 - The sale of articles bearing the POLICE-GENDARMERIE-DOUANE logo is strictly reserved to the staff of these institutions. A10 Equipment® cannot be held responsible for any failure to comply with these regulations. 

ARTICLE 4 - AVAILABILITY OF ITEMS

Our product offers are subject to the availability of products.

We will notify you by email or post as soon as we can. You may then request the cancellation or exchange of your order by writing to: info@a10-equipment.com. 

ARTICLE 5 - DELIVERY

DELIVERY IN METROPOLITAN FRANCE.

Products are delivered to the address you specify at the time of ordering. The delivery includes the product(s) ordered, packaged and a detailed invoice.

The average delivery time is 24 hours (working days). For items costing more than €500 per item, delivery may take up to 8 days.

These are average times for processing and delivery to the French mainland. They are not strict deadlines. A10 Equipment® cannot be held responsible for late delivery or stock shortages.

For all orders under €90.00 inc. VAT (excluding handling and shipping costs), a fixed contribution to shipping costs will be applied depending on the carrier chosen.

For orders over €90.00 inc. A10 Equipment® will cover the shipping and handling costs.

 

DELIVERY OUTSIDE METROPOLITAN FRANCE

For deliveries to overseas territories (DOM-TOM) or international destinations, prices may vary based on the country of delivery, package weight, and chosen delivery method. Therefore, it is advisable to contact us in advance at:

It is the customer's responsibility to inspect the condition of the goods upon delivery and to report any issues to the carrier in case of receiving a damaged parcel. This should be noted on the carrier's delivery document and communicated to A10 Equipment® within 72 hours (working days). After this period, the delivery and products are considered conforming and free from defects.

In the event of an obvious defect or non-conformity in the delivered products, as duly acknowledged by A10 Equipment®, the customer may, at A10 Equipment®'s discretion, receive free replacement or reimbursement of the products, excluding any compensation or damages.

Upon dispatch of every order, a confirmation email containing the parcel's tracking details is sent to the customer. 

ARTICLE 6 - PAYMENT

Payment Terms:

The price must be paid in full, either in cash, by bank card, or through Paypal, and in a single installment at the time of placing the order. We accept only bank cards bearing the initials CB, VISA, or MASTERCARD issued in France or within international networks approved by the GIE Cartes Bancaires.

 

In all cases, providing the bank card number online and the final validation of the order will serve as evidence of the order's completeness in accordance with the provisions of the law dated March 13, 2000.

If you are dissatisfied with an item, you may return it to us by post within 14 days of receiving your parcel, at your own expense. Please send returns to the following address:

The item must be new and unused. All you need to do is return it in its original packaging, along with a copy of the delivery note or invoice and the reason for the return. Please also specify whether you are requesting a refund or an exchange. Except in the case of an error on our part, in which case the cost of returning the product will be covered on the basis of the A10 Equipment® price list, all other costs and risks will always be borne by the purchaser.

All product returns must be the subject of a formal agreement between the seller and the buyer. Any product returned without this agreement will be kept at the buyer's disposal and will not be refunded. No returns will be accepted after 14 days from the date of delivery.

Goods returned must be accompanied by a return slip and be in the condition in which they were delivered by the supplier. 

Consequences

 

ARTICLE 8 - WARRANTY

All items are covered by a contractual guarantee which does not exclude the statutory guarantee provided for in articles 1641 et seq. of the French Civil Code or the obligation to supply goods in accordance with the decree of 17 February 2005.

The articles are guaranteed against any material or manufacturing defect for a period of 2 years from the date of invoice.

 The invoice and/or delivery note accompanying your order will serve as the guarantee. A10 Equipment® will examine the returned product and, if the customer's complaint is covered by this contractual guarantee, A10 Equipment® undertakes to replace the product free of charge with the same or a similar product.

Otherwise, the contractual guarantee will not apply: - in the event of improper use or modification of the product:

- in the event of willful damage by the customer

- if the product has suffered external damage such as a fall, impact, fire, etc.

 

Article L.211-4 of the Consumer Code

The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity at the time of delivery.

 He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation if the latter was his responsibility under the contract or was carried out under his responsibility.

 

Article L.211-5 of the Consumer Code

In order to be in conformity with the contract, the goods must:

be fit for the use normally expected of similar goods and, where applicable: correspond to the description given by the seller and possess the characteristics which the seller has presented to the buyer in the form of a sample or model possess the characteristics which a buyer may legitimately expect having regard to public statements made by the seller, the producer or his representative, in particular in advertising or on the label, or possess the characteristics defined by mutual agreement between the parties or be fit for any special purpose requested by the buyer, communicated to the seller and accepted by the seller. 

Article L.211-12 of the Code de la Consommation.

Article 1641 of the French Civil Code

The seller is liable for any hidden defects in the goods sold which render them unsuitable for their intended use, or which impair their use to such an extent that the buyer would not have purchased them, or would have paid a lower price for them, had he been aware of them.

Article 1648 of the French Civil Code - paragraph 1

The customer must bring an action for material defects within two years of discovering the defect.

 

ARTICLE 9 - RETENTION OF TITLE

A10 Equipment® retains ownership of the products sold until effective payment of the full price of the main product and accessories.

 This retention of title clause does not prevent the transfer of risk to the customer upon delivery of the products. Consequently, upon delivery, the products become the responsibility of the customer, who shall bear all risks of loss or damage and shall take out all necessary insurance.

 A10 Equipment® may, by express agreement, exercise its rights under this retention of title clause, for any of its claims, on all its products in the possession of the customer, the latter being conventionally considered to be those that have not been paid for, and A10 Equipment® may take them back or claim them as compensation for all these unpaid invoices, without prejudice to its right to cancel sales in progress.

ARTICLE 10 - CONDITIONS OF USE OF THE SITE

10.1 - Intellectual property

The present website is intended for personal, non-commercial use. The user is authorized to view and copy the content of the site and the material contained in the site and to use the site and the material contained in the site for their own personal use and for no other purpose. Furthermore, all elements reproduced on our site (logos, photographs, products, texts, graphic charter...) protected by the Intellectual and Civil Code are the property of A10 Equipment®.

Consequently, none of these elements may be displayed, downloaded, reproduced, transmitted, translated, sold, exploited commercially or free of charge or reused in any way. All elements used must therefore correspond to their original images and be presented with their respective logos.

 

10.2 - Liability

This website is provided for your convenience only. Despite the care taken by the Site's team to correct any errors, inaccuracies and/or imprecisions and to prevent the introduction of viruses, the Site's team cannot fully guarantee the accuracy and reliability of all or part of the Site's content. Users acknowledge and accept that use of the Site is at their own risk.

 

ART. 11 - RESPONSIBILITY

11.1 - A10 Equipment® shall not be liable for any material, immaterial or physical damage which may be the result of improper use of the products on sale. The company A10 Equipment® assumes responsibility towards the customer for the products delivered, in accordance with the regulations in force.

11.2 - The photos and text used to illustrate the products shown have no contractual value. A10 Equipment® may not be held liable in the event of an error in any of these photographs or in any text.

11.3 - A10 Equipment® may not be held liable for failure to perform the contract in the event that a product is out of stock or unavailable, or in the event of force majeure. Force majeure shall include all cases recognized by law and any malfunction of the Internet network, any interruption or total or partial strike, in particular of postal services and means of transport and/or communication, flooding, fire, etc. 

11.4 - Items bearing the logo of the POLICE-GENDARMERIE-DOUANE-SAPEURS-POMPIERS are strictly reserved for the personnel of these institutions; in accordance with article 433-14 of the Penal Code, any person who, in public and without right, does any of the following is liable to one year's imprisonment and a fine of 15,000 euros

1° Wearing a costume, uniform or decoration regulated by the public authorities

2° Use of a document certifying a professional capacity or a badge regulated by the public authorities.

Consequently, the purchaser expressly acknowledges that products bearing the logo and/or insignia and attributes of a public order or authority are strictly reserved for the personnel of these institutions and that the company cannot be held liable in the event of a breach of the law or failure to comply with regulations.

In the event of an inspection, A10 Equipment® must provide the competent authorities with the identity of the purchasers of these items.

Knives and daggers are category 6 weapons that are likely to constitute a threat to public safety. Article 46-1 (of the May 1995 decree) prohibits the acquisition by minors of weapons or parts of weapons in category 6. This provision therefore prohibits minors from possessing knives or daggers.

We only ask you for the information that is necessary (surname, first name, address, e-mail) for the quality processing and careful follow-up of your order. ARTICLE 13 - APPLICABLE LAW - POSSIBLE DISPUTES

French law is applicable to this contract. The language of this contract is French.

The server of the website is located in France, but the website is accessible from anywhere in the world. As each country may have laws that differ from French law, the User accepts without reservation that the mere fact of ordering a product and/or consulting the Site necessarily subjects him/her to French law. In the event of a dispute arising from this contractual relationship, the parties undertake to seek an amicable solution before resorting to legal proceedings. 

ARTICLE 14 - JURISDICTION

Any dispute relating to the application of these general terms and conditions of sale and their interpretation, their execution, the sales contracts concluded by A10 Equipment® or the payment of the price shall be submitted to the courts of STRASBOURG, regardless of the place of order, delivery, payment or method of payment, even in the event of a guarantee or multiple defendants.

Bills of exchange do not modify or derogate from this jurisdiction clause.

The assignment of jurisdiction is general and applies whether the claim is a principal claim, an ancillary claim, an action on the merits or a summary proceeding.
